      <title>Wearing Headphones While Walking Can Lead to Pedestrian Accidents</title>
      <description>&lt;p&gt;It seems the Palm Beach Post reports at least one pedestrian accident in Palm Beach each week. Some weeks report even more.&lt;/p&gt;
&lt;p&gt;A recent study found that pedestrian accidents are increasing in urban areas. Victims aren&amp;rsquo;t children or the elderly&amp;mdash; the groups traditionally at the highest risk of a Florida pedestrian accident injury. Instead, the victims are young men under the age of 30. These men have one thing in common: they are wearing headphones. The number of pedestrian accident injuries and deaths where the victim was wearing headphones has more than tripled since 2004.&lt;/p&gt;
&lt;p&gt;The study was conducted by researchers at University of Maryland School of Medicine and was published in the January 16&lt;sup&gt;th&lt;/sup&gt; online issue of the journal, &lt;em&gt;Injury Prevention. &lt;/em&gt;The authors conducted the study because while much is known about the effects of distraction on drivers, there has been little research carried out about distracted pedestrians.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The study focused on 116 reports of death or injury of pedestrians using headphones. In about one-third of the crashes, the vehicle sounded a warning before the accident occurred. However, the pedestrian likely didn&amp;rsquo;t hear the warning. Researchers concluded that pedestrians who use headphones put themselves at risk. These researchers urged that more studies focus on the role of pedestrian distraction.&lt;/p&gt;
&lt;p&gt;While Florida pedestrians have a responsibility to be careful around traffic, drivers also have a duty to watch for pedestrians. &lt;p&gt;The study was conducted by researchers at the University of Virginia and was published in the October 2011 edition of the American Journal of Public Health. Investigators examined National Highway Transportation Safety Administration (NHTSA) accident data collected over ten years. They found that women wearing seatbelts are 47 percent more likely to suffer injuries in a Florida car crash than male drivers wearing seatbelts. Women were also more likely to suffer spine and chest injuries and injuries to the lower extremities.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Researchers believe women are more vulnerable to car accident injuries because safety features are designed for men. The female drivers in the study were an average of 35 pounds lighter and five-and-a-half inches shorter than the male drivers. Women&amp;rsquo;s bodies are also shaped differently. Although this seems obvious, differences in neck strength and muscle structure may also account for the difference in injury rates.       <title>Children at Risk of Injury from West Palm Beach Pedestrian Accidents</title>
      <description>Three children were hospitalized this week after two separate West Palm Beach pedestrian accidents.&lt;br&gt;
The first Palm Beach County accident occurred shortly before 5:00 p.m. on Monday, January 9. Two boys, ages 12 and 13, were riding a small, powered scooter near North Sapodilla Avenue and 4th Street. The boys ran a stop sign and were hit by a car believed to be either a Pontiac or a Buick. The driver left the scene. The boys were taken to St. Mary's Medical Center. Their injuries are not believed to be life threatening.&lt;br&gt;
Another child was injured around 6:30 p.m. on Tuesday, January 10. An 8-year-old boy, riding his bike in the parking lot of the Palm Grove Apartments on Australian Avenue, was hit by a Nissan Pathfinder. The boy was also taken to St. Mary's Medical Center. He was treated for minor injuries and is expected to make a full recovery.&lt;br&gt;

      <description>In 2010, traffic fatalities in Florida reached a 33-year low. Preliminary figures show that for the sixth consecutive year, car accident deaths in Florida continue to drop. In 2011, 2,373 people were recorded as having died in Florida car crashes. This is the lowest number of fatalities since 1978, when the population of Florida was only half of what it is today.&lt;br&gt; Palm Beach County shows a similar trend. There were 117 traffic accident deaths in 2011, compared to 123 the year before.&lt;br&gt; Officials believe that the decreased number of accidents can be attributed to the construction of safer roads and the installation of better guard rails, as well as driver education and law enforcement efforts. Last year, at least 3,092 motor vehicle fatalities were attributed to distracted drivers. This number comes from law enforcement records; however, not all departments keep records, nor is it always possible to know if distraction is the cause of a crash. Experts believe that the actual number is much higher.&lt;br&gt;
Laws banning texting or cell phone use by drivers in Florida have been proposed at every legislative session since 2002, but none have passed. While officials recognize the dangers of distracted driving in Florida, the majority of Florida law makers oppose prohibiting the practice. Florida House Speaker Dean Cannon says he opposes laws that support "government-regulating private behavior."&lt;br&gt;
Representative Irv Slosberg, D-Boca Raton, is sponsoring legislation for 2012 that would prohibit school bus drivers and drivers under age 18 from using hand-held cell phones and other devices while driving. Two senators have also proposed bills to limit distracted driving in Florida. Senator Thad Altman, R-Viera, has proposed a bill that would ban drivers younger than 18 from using a phone while driving, and Senator Nancy Detert has proposed a bill to ban texting while behind the wheel.&lt;br&gt;

      <title>Newspaper Investigation Finds Cops are Florida's Worst Speeders</title>
      <description>&lt;p&gt;A recent investigation by the Sun Sentinel has found that police officers routinely speed on South Florida highways. What&amp;rsquo;s even more shocking is that many of these officers were off-duty at the time.&lt;/p&gt;
&lt;p&gt;The Sun Sentinel obtained a year's worth of police SunPass toll records. They used a GPS device to figure out how quickly the cops must have been travelling based on the time it took to get from one toll plaza to the next. What they found was that almost 800 police officers from 12 different agencies were driving at speeds of 90 to 130 mph.&lt;/p&gt;
&lt;p&gt;The investigation began after a Miami police officer was caught driving 120 miles per hour through Broward County on his way to a second job. The newspaper found that:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;793 different transponders assigned to police officers in Miami-Dade, Broward, and Palm Beach counties showed evidence of speeding.&lt;/li&gt;
&lt;li&gt;5,100 speeding incidents were recorded in a 13-month period.&lt;/li&gt;
&lt;li&gt;Many officers were habitual speeders.&lt;/li&gt;
&lt;li&gt;Twenty percent of police cars reached speeds greater than 90 mph. Some reached speeds as great as 130 mph.&lt;/li&gt;
&lt;/ul&gt;
&lt;h3&gt;Why do police officers speed?&lt;/h3&gt;
&lt;p&gt;Cops rarely stop other cops for speeding. When police officers are stopped, they are rarely punished.&lt;/p&gt;
&lt;h3&gt;How much of a problem is speeding by police officers?&lt;/h3&gt;
&lt;p&gt;Since 2004, speeding law enforcement officers have caused at least 320 Florida car crashes and 19 deaths. But, cops are rarely punished for causing Florida highway accidents. Only one officer involved in a high-speed crash served jail time; he was sentenced to 60 days.&lt;/p&gt;

      <title>Two Die in Lake Worth Auto Accident</title>
      <description>&lt;p&gt;Two men are dead after a Lake Worth traffic accident that occurred when another vehicle crashed into the side of their car.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The Palm Beach County car accident occurred on Friday, February 10 at 7:06pm in the 3500 block of South Military Trail in Lake Worth. Forty-three-year-old Allen Holyfield and his passenger, 60-year-old Thomas Tetrault, were in a 1995 Jeep Wrangler that was headed northbound on South Military Trail. As Holyfield turned left onto Clement Street, his car was hit by a white 2000 Crown Victoria. Both men were thrown from the Jeep.&lt;/p&gt;
&lt;p&gt;Allen Holyfield died at the scene. Thomas Tetrault was taken to Delray Medical Center by Trauma Hawk, but he also died from his injuries.&lt;/p&gt;
&lt;p&gt;The driver of the Crown Victoria, eighteen-year-old Johan Martinez, was also injured. He was taken to JFK Medical Center in Atlantis where he was treated and released.&lt;/p&gt;
&lt;p&gt;The accident is still under investigation. No charges have been filed.&lt;/p&gt;
&lt;p&gt;Turning left is the most dangerous move for a driver. In Florida, a driver must signal his intent to make a left turn at least 100 feet before reaching the intersection. The driver must yield to any pedestrians, bicycles or vehicles coming from the opposite direction. For this reason, a driver making a left turn is almost always liable to the driver coming from the opposite direction. But, there are exceptions. The other driver may be liable if:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;The car going straight was speeding or going too fast for road conditions.&lt;/li&gt;
&lt;li&gt;The car going straight ran a red light.&lt;/li&gt;
&lt;li&gt;It was safe to turn when the driver began the left turn, but something unexpected happened and the driver had to slow down or stop the turn.&lt;/li&gt;
&lt;/ul&gt;

For example, while there are five times more car crash deaths than motorcycle accident deaths, the number of motorcycle deaths per mile driven is 30 times greater than car accidents per mile. This means a motorcyclist has a 30 times greater risk of dying in a Florida traffic accident than the occupant of a car.&lt;/p&gt;
&lt;p&gt;Some more facts from Traffic STATS:&lt;/p&gt;

&lt;li&gt;Male drivers have a 77 percent higher risk of dying in a Florida car crash than female drivers.&lt;/li&gt;
&lt;li&gt;The morning rush hour is the safest time to drive. The most dangerous time is 2:00am, when bars close.&lt;/li&gt;
&lt;li&gt;The safest passengers are four-year-olds in a car-seat.&lt;/li&gt;
&lt;li&gt;Vans are twice as safe as cars; school buses are 50 times safer.&lt;/li&gt;

      <title>Man Injured in Palm Springs Motorcycle Accident: Who Caused the Crash?</title>
      <description>&lt;p&gt;A Wellington man is recovering from serious injuries after a motorcycle crash near Palm Springs.&lt;/p&gt;
&lt;p&gt;The Palm Beach County motorcycle accident occurred on Friday, February 3. Twenty-two-year-old James Swan was riding his motorcycle northbound on Military Trail near Palm Springs. He was at the intersection of Military Trail and Broadway Street when a 2005 Ford van made a right turn off Broadway and headed directly toward the motorcyclist. Swan tried to avoid the van, but ended up crashing into its right side. The motorcycle flipped. Swan, who was not wearing a helmet at the time of the crash, sustained serious injuries. He was flown to Delray Medical Center for treatment.&lt;/p&gt;
&lt;p&gt;According to the Palm Beach County Sheriff's Office report, the accident was caused by 61-year-old Richard McBrayer Sr. of Lake Worth, when he invaded Swan's right of way. However, McBrayer disputed the police report. He claims the motorcyclist was speeding at about 65 miles-per-hour.&lt;/p&gt;

      <title>One Driver: Five Florida Auto Accidents in Five Minutes</title>
      <description>&lt;p&gt;A Fort Meade man was arrested after causing five separate Florida car crashes in less than five minutes.&lt;/p&gt;
&lt;p&gt;The five Florida traffic accidents occurred in Polk County on Monday, January 23 between 2:45pm and 2:50pm. Forty-seven-year-old Curtis Gunter was driving a green Kia Sorrento when he crashed into a second vehicle near Flamingo Drive in Bartow. Gunter then got on State Route 60, where he headed east in the westbound lanes. As he approached North 91 Mine Road, Gunter caused two more crashes. The fourth crash occurred near Rifle Range Road just west of Dusty's Camper World.&lt;/p&gt;
&lt;p&gt;Several witnesses called the police to report erratic and wrong-way driving. A police officer was sent to the scene to stop the driver. He was placing a spike strip on the highway near Rifle Range Road, when Gunter drove his Kia into the officer&amp;rsquo;s patrol car. The fifth crash stopped the SUV, and the reckless driver was arrested.&lt;/p&gt;
&lt;p&gt;None of the crashes involved serious injuries. However, all of the cars sustained property damage.&lt;/p&gt;

      <title>Three Injured in West Palm Beach Pedestrian Car Crash</title>

The SUV hit a young man who was standing on the median. A second man standing next to the victim was able to jump out of the way. The vehicle then flipped and landed on its side in front of the Days Inn at 2300 45th Street.&lt;br&gt;
The man who was hit by the vehicle sustained serious injuries. The driver, a man in his thirties, exited the SUV and attempted to flee the scene. He was tackled and restrained by the second man at the median. Both men suffered minor injuries. All three were taken to St. Mary's Medical Center for treatment.&lt;br&gt;
The Florida pedestrian accident is still under investigation. Police say the driver will probably be charged with hit-and-run leaving the scene of an accident. They suspect the driver was under the influence of alcohol or drugs, but no additional charges will be filed until blood test results are obtained.&lt;br&gt;

      <title>Cab Driver Dies in West Palm Beach Parking Lot Accident</title>
      <description>A West Palm Beach taxi cab driver and resident of Lake Worth, Luis Jimenez, was killed by an impaired driver while the victim was talking to other cab drivers in the El Toro nightclub parking lot. The accident occurred on Sunday, January 8, at 1999 South Military Trail.&lt;br&gt;
Twenty-six-year-old Juan Diego Martinez of Lake Worth drove into the parking lot and lost control of his 1998 Oldsmobile. He crashed into a parked car and then hit the group of cab drivers. He then hit two more parked cars before coming to a stop. Three unidentified passengers left the car and fled on foot.&lt;br&gt;
Jimenez was pinned under the car and died at the scene. The other men, Julio Vazquez and Bernardo Martinez, sustained minor injuries. Vazquez was taken to JFK Medical Center.&lt;br&gt;
Martinez admitted to drinking alcohol and smoking marijuana shortly before the crash. He now faces charges of DUI manslaughter, vehicular homicide, driving without a driver&amp;rsquo;s license and causing death, two counts of DUI resulting in personal injury, and four counts of DUI causing property damage. Martinez is illegally in the United States from Mexico and was denied bail.&lt;br&gt;

      <title>Three Die After Car Crash on I-95 in Jupiter</title>
      <description>Ann Lane and her sister Loretta Brunetti always enjoyed their annual winter visit to see a third sister in Boca Raton. This year, the elderly women invited a friend. Unfortunately, they never reached their destination. The three travelers lost their lives when their car crashed on I-95 in Jupiter.&lt;br&gt;

They rented a Honda CR-V to continue their journey to Boca Raton. After heading south on I-95 just north of Donald Ross Road, their car veered off the road and hit both a light pole and a retaining wall. The vehicle went over the wall and landed in a drainage pond.&lt;br&gt;
All three Florida accident victims were alive but in cardiac arrest when emergency personnel arrived at the scene. Ms. Lane and Mr. Koeniges were taken to St. Mary's Medical Center. Ms. Brunetti was taken to Jupiter Medical Center. All three died from their injuries.&lt;br&gt;
Mr. Koeniges was a volunteer firefighter in Haworth, NJ. Ms. Lane had worked in airport operations in Newark, NJ. Ms. Brunetti was a receptionist in a doctor's office. The sisters are survived by their children, grandchildren and two remaining sisters.&lt;br&gt;
When the car was pulled from the drainage pond, the vehicle's right front tire was not attached to the front axle. It is not known whether a problem with the tire is responsible for the accident. The fatal Jupiter car crash remains under investigation.&lt;br&gt;

The injured teen was flown by Trauma Hawk to St. Mary's Medical Center in West Palm Beach where she is in critical, but stable condition.&lt;br&gt;
The accident is still under investigation. Both the teen driver and her father received traffic citations after the crash. The state Department of Children and Families may be notified and the father may face possible charges of child neglect and child endangerment. The extent of Mr. Savela&amp;rsquo;s injuries has not been announced.&lt;br&gt;&lt;br&gt; An investigation led police to suspect that Ohigashi was responsible for the crash. Police received word that the woman, who was impaired by narcotics at the time of the accident, may have been planning to flee the country. Ohigashi was arrested and will face charges of causing serious bodily injury.&lt;br&gt;&lt;br&gt; This is the second serious bicycle-car accident in Palm Beach County in less than a week. On Thursday, December 16, a bicyclist was killed when he crossed Lake Worth Road west of Kirk Road and was hit by a westbound car. The bicyclist was intoxicated.&lt;br&gt;</description>

Ninety-four-year-old Eunice Dekiel of Mallards Cove had just finished grocery shopping at Publix and was on her way home. She never reached her destination. As she was crossing the southbound lanes of Central Boulevard, she was struck in the leg by a dark-colored SUV. The driver did not stop and left the scene.&lt;br&gt;&lt;br&gt; A man who was working in a nearby office heard the noise and found Ms. Dekiel lying in the middle of the road. He called for medical assistance.&lt;br&gt;&lt;br&gt; Dekiel was taken by Trauma hawk to St. Mary&amp;rsquo;s Medical Center. In the attempt to avoid the stopped car, his 2002 Ford pickup truck veered out of control.&lt;br&gt; Mr. Gonzalez&amp;rsquo;s pick-up truck jackknifed into the semi-truck and hit a fourth vehicle, a 1992 Honda sedan driven by 34-year-old David Deese of West Palm Beach. Mr. Deese had to be extricated from his vehicle; both Deese and Gonzalez were seriously injured. They were taken to St. Mary's Medical Center for treatment. The Palm Beach County car accident occurred at about 3:30 p.m. on Wednesday, December 7 at the intersection of Military Trail and Old Boynton Beach Boulevard. Maurice Gartman, 85, and his wife, Evelyn Gartman, 82, were traveling west on Old Boynton Road when their Hyundai was struck by a Ford SUV travelling south. The driver of the SUV, 18-year-old Alexander Worrall of Boynton Beach, had failed to stop for a red light.&lt;br&gt;
Mr. and Mrs. Gartman had to be extricated from their vehicle. Both of the accident victims sustained serious injuries. They were taken to Delray Medical Center for treatment. There is no word about their condition.&lt;br&gt;
Worrall sustained minor injuries. Police performed testing for drugs and alcohol and are waiting for results before determining whether Worrall will face charges.&lt;br&gt;

      <title>West Palm Beach Accident Lawyer Holds Bars Accountable for DUI Death</title>

The accident occurred at the intersection of Southern Boulevard and Lamstein Lane. John Serratore stopped for a red light, and when it turned green, he pulled into the intersection. A drunk driver t-boned his car. Mr. Serratore sustained fatal injuries and died at the hospital.&lt;br&gt;
Tracy Klinedinst, the driver who hit Mr. Serratore, had been drinking since 7:30 that morning. He jumped out of his van and ran from the scene. He was later arrested on charges of vehicular homicide, driving under the influence, failure to stop after a crash involving death, and cocaine possession. In February, Klinedinst plead guilty to DUI manslaughter and was sentenced to 12 years in prison.&lt;br&gt;
