Man Dies In Loxahatchee Garbage Truck Roll-over Accident

Posted on Aug 31, 2012

A Riviera Beach man is dead after falling under a garbage truck.

The Loxahatchee trucking accident occurred on Friday, August 17, shortly before 12:49 p.m. Charles Sears, 49, of Riviera Beach and Luis Marin Perez, 38, of Lake Worth, were collecting garbage on 91st Place North near the intersection of Seminole Pratt Whitney and Northlake Boulevard. Perez was driving a large garbage truck owned by Waste Pro Management. As he approached a house, he drifted onto the south shoulder of the road. The truck began to slide into a ditch. Perez tried to avoid getting stuck in the ditch by jerking the steering wheel in the opposite direction. This caused the truck to roll over on its passenger side.

When the truck rolled, Sears was thrown out of the truck. He slid beneath the vehicle and the truck crushed his lower body. He died at the scene.

Perez did not sustain injuries. The accident is under investigation by the Palm Beach County Sheriff's Office. Driver error is suspected to be the cause of the crash. The driver will be tested for drugs as part of standard procedure.

When a person dies in a work-related accident, the family of the victim may be eligible for Florida worker’s compensation benefits. If another party was responsible for the accident, the family may also be able to file a wrongful death claim. It is hard to determine who is responsible for a Florida trucking accident without a thorough investigation, so Palm Beach accident attorney David Glatthorn advises families to speak to a lawyer about their case.

David Glatthorn and his team offer their condolences to the family of Mr. Sears.
