- 5 Ways Your Florida Personal Injury Claim can be Sabotaged - West Palm Beach Attorney Dave Glatthorn
West Palm Beach attorney David J. Glatthorn explains five different ways you can sabotage your own personal injury case.
As we try to protect you from different sources that might try to harm your case, you need to watch out so you don’t harm it yourself. Not seeking medical attention immediately is the first step to sabotaging your own case. Even if you feel sore and weak, going to see a doctor is a must. We must prove injury to win your case. Also, when you see the doctor make sure you give a full history of any injuries or symptoms you may have had before. The insurance company can use the parts you left out against you, no matter how relevant they are. If you choose to not tell your doctor all the symptoms you have it can be very detrimental to your case. If you tell the doctor about one pain but not another, then they don’t have the full story and cannot be helpful to you. Make sure you also follow-up with your doctor and record these visits. No matter how you feel, you must follow through on seeing the doctor regularly. Lastly, never exaggerate the details of your case. When dealing with an insurance company, they are overly aware of what you’re saying and can take a small exaggeration and use it against you in your case. You’re being interrogated by them and any comment will be picked apart. Watch the video now to learn more.

West Palm Beach attorney David J. Glatthorn explains how a lawyer proves responsibility in a big truck accident.
Putting together a case regarding a big truck takes prompt action on part of the lawyer. We want to get the truck in the same condition it was right after the accident. We get a mechanic involved and even an expert who can reconstruct car accident scenes to help us determine the cause of the crash. Also, big truck companies keep logs on all drivers including maintenance records, mileage, how long the driver has been driving every day, and other things that can help us piece together how things happen. Everything needs to be analyzed and complied with. These specialists help us reconstruct the very event, giving us everything we need to go forward with your case. Watch the video now to learn more.

A client of ours came to us when her husband had died in a truck accident. By all reports, it looked as if her husband had run off the road and flipped the truck. However, by looking closer at the accident report, we noticed that heavy congestion had caused another accident and we began to investigate. Witnesses helped explain the situation and recall how another truck had caused the first accident and as a result cars began to veer out of the way and into other traffic. One car had veered out of the way of a collision and into the path of our client’s husband. Further more we found out that the first driver was currently in a drug rehab and should have never been driving. Watch the video now to learn more.

West Palm Beach attorney David J. Glatthorn talks about how black box recorders are changing the way we look at automobile accidents.
If you’ve been in an accident, there are many different ways in which we help prove your lawsuit. One way is hiring an expert who can reconstruct the accident and find who is at fault. A helpful device in this process is a black box data recorder. This unit records everything from whether brakes were applied to which angle the vehicle was hit. You add this information along with everything else that comes from an accident investigation and you can truly show how the accident happened. This can in turn show which person is at fault and help win your case. Watch the video now to learn more.
- Florida Auto Insurance Changes Coming July 1, 2012
West Palm Beach attorney David J. Glatthorn explains how new Florida laws are changing your insurance policy coverage for automobiles.
As of July 2012, there will be changes made to your PIP (Personal Injury Policy) section of your policy. If you’re involved in an accident, you’ll need to get medical attention and initial care within 14 days of the date of the accident. While seeking medical treatment, you may be asked to go to a doctor that the insurance company has chosen. It’s important to understand that the insurance company pays the doctor – not you. Plus, the insurance company does not want to pay out coverage benefits. They will do the best possible to avoid these costs. A doctor will need to determine if you have an “emergency medical condition” which will notify the insurance company on how much to pay out. You may be paying for a $10,000 insurance policy, but you only have rights to $2,500. This can be changed, but only if your doctor labels your injuries as that emergency medical condition. Within these changes, the insurance company also has the right to examine you under oath if you’ve been injured in an automobile accident. This, of course, gives the insurance company yet another part of your policy to be in control of. Watch the video now to learn more.
- Who Pays for the Property Damage to My Car? West Palm Beach Lawyer Explains
http://www.davidglatthornlaw.com/ West Palm Beach attorney David J. Glatthorn answers the question of who pays for the property damage to your car if you're involved in an accident.
Payment for damage depends on a couple factors. If the other driver is clearly responsible, then their insurance company should be doing the right thing and taking care of that cost. If the responsibility to who was at fault is uncertain, then you may need to handle your costs with your own insurance company based on your policy limits. Comprehensive collision is a good asset to have for your policy in this type of situation. You may also suffer from hidden damages, which is basically damage that cannot be seen but affects the health of your car (like engine damage). We can help you with all of these concerns. - Children and Heat Stroke: The "Baby in Back!" Program
West Palm Beach attorney David J. Glatthorn discusses how he joined forces with the local Safety Council to reach out to the public regarding the prevention of babies dying.
Unfortunately, there are a myriad of reasons why babies can die. One of the more tragic deaths is from being left inside a car on accident. With nearly 40 children dying every year, this is a problem that needs to be addressed. Most people would be shocked to learn that parents who are responsible for these accidents range from all different economic and cultural backgrounds. This tragedy happens to doctors just as it does to housekeepers. Our law firm joined in a public effort with the Palm Beach County Safety Council to help these deaths from happening. We invested in 10,000 bracelets labeled “Baby in Back” to be as a reminder to the parent. They can wear them and hang them in the car to be a constant reminder to stop these simple accidents from happening. Watch the video now to learn more.
- What is Board Certification?
West Palm Beach attorney David J. Glatthorn defines what the term board certification means how it can be the difference between winning your case and losing it.
When you’re ready to seek compensation from someone who injured you or your family, you want the best person possible to handle your case. While every lawyer can tell you how many cases they’ve won or lost, they can also show you testimonials and how happy their clients are. So how do you separate the good from the great? The way the legal system does it is by having the lawyer go through a board certification process. This process measures a lawyer who has reached a more experienced level. The certification is only allowed once a lawyer has had a number of trials and a number of years of experience. Along with that they must have recommendation letters from judges and other respected legal professionals and pass written exams. With all this expertise, a lawyer with a board certification is your best chance to getting the best possible person to assist you in winning your lawsuit. Watch the video now to learn more.
- What is a Deposition?
West Palm Beach attorney David J. Glatthorn explains another important part of the lawsuit process – the deposition.
Whether you know it or not, you may already understand what a deposition is. You’ve watched them on television thousands of times in your favorite crime or legal drama. A deposition is a question and answer session a person has with their attorney and the other attorney present. Also, there may be other people such as a court reporter present to record the answers. A deposition is a fundamental and vital part of the lawsuit process, whether or not there is a trial. Your answers to the questions are being analyzed and examined by both sides and they need to be honest. Those questions are more than likely going to be asked again if there is a trial, so you need to make sure your answers are the same as given at deposition. It’s alright to say you don’t know the answer to a question. It’s honest. It’s more important to be honest and try to get to the real answers, then not tell the truth or guess at it. - Boating Accidents are Different Than Car Accidents
West Palm Beach attorney David J. Glatthorn conveys how boating accidents are definitely different than the average car accident.
With a state like Florida, there are plenty of chances to jump in the water or glide off in a boat to enjoy your day. But not unlike cars, boats need to have someone operating them who can be safe and drive it correctly. Boats have multiple reasons for causing an accident, not just a basic crash. Equipment failure or lack of the right equipment can also lead to many accidents. Lawsuits involving boats are also quite different from automobile accidents. How much time you have to file a suit is just as important as where the accident actually happened. Did it happen in open water? Is the driver of the boat at fault or the owner? With so many different questions to ask, it’s important to have an attorney who is experienced in this area. Watch the video now to learn more.
- Golf Carts: Accidents & Insurance
West Palm Beach attorney David J. Glatthorn explains how golf cart accidents are on the rise and how one age group is a surprising large number of victims.
As golf carts become more versatile, they are popping up in all different types of situations and being enjoyed by more age groups than just the expected senior citizens. Golf carts are used as security vehicles, urban transportation, and as a quick ride within golfing communities which combine homes and golf courses all within riding distance. With the popular growth, accidents have obviously risen. Golf carts are becoming increasingly popular with people under the age of 16 as well. Although it is not a typical car, a golf cart can cause serious injury as it is not designed with safety devices like an automobile. Golf carts typically do not have seat belts or anything else safety related other than a bar to hold onto. This, added with young drivers, leads to an explosion of golf cart accidents around the country. You need someone who understands how the laws work and apply to golf carts in your personal injury case. Watch the video now to learn more.
- What is an Exam Under Oath?
West Palm Beach attorney David J. Glatthorn discusses another process in a personal injury lawsuit, the examination under oath.
After an accident, the insurance company will have many questions regarding your accident and will need to investigate into your case. One way they do this is by an examination under oath. What this means is that you will be asked questions by the insurance company with a court reporter present. Your answers are recorded so that both your insurance company and your lawyer will be able to return to this information in your case. What you must remember is that the insurance company does not want to pay out your premiums and have any cost. You need to know that an insurance company examination is very important and can have a large ramification on your case. Watch the video now to learn more.

An attorney needs quite a few tools to show how your injury not only affects your health, but your employment and financial life. The attorney needs to show not only the affect now, but how the injury will affect you in the future. The use of experts is one way to do this. Through physical and vocational rehabilitation specialists, and also economists, we can show what your capacities are. Whether or not you can lift as much weight as you did previously, whether or not your job is now suited for you, and whether or not you can make the same type of money you made before the injury took place. - Presenting Injuries in a Trial- WPB Attorney David Glatthorn Explains
http://www.davidglatthornlaw.com/- West Palm Beach injury attorney David J. Glatthorn explains how he presents a client's injuries to a jury so that they can understand.
While at trial, the most important thing is to make sure that the jury fully understands the medical and non-medical issues you have suffered from, currently suffer from, and will suffer in the future. We do this in a number of ways. We use photo boards with both x-rays and artist illustrations to walk you through procedures that had to be completed. There are several reasons for this. One is that a doctor may not help you understand this while reading off the list of symptoms and diagnosis for the client. Another is that some of those injuries will have been treated and healed by the time of the trial. Just because a person can move their arm at trial doesn't mean it wasn't fractured and had to be fixed with rods or nails. We want to show how our client's life has been affected. In other words, what can you do now or what you can do in the future? We bring in economist to determine the actual dollar costs of your medical and non-medical bills. They need to help the jury understand economic losses and a money value. They determine everything from labor, loss of services and even future medical expenses - all while calculating inflation. http://www.davidglatthornlaw.com/library/3-things-you-must-know-about-florida-s-new-pip-law.cfm In this video, West Palm Beach car accident lawyer David Glatthorn explains why your insurance company has to pay your medical bills even when the other driver is at fault. In the state of Florida, everyone is required to have personal injury protection insurance – called PIP for short. This is the insurance that pays for medical bills after a car accident. Because Florida is a no-fault state, your insurance pays no matter what - such as your fault, their fault, or a third party. This insurance can also extend to pedestrians, so it’s helpful if you are not in a car and are involved in some type of accident with a vehicle. - Are Independent Medical Examinations Really Independent? Part 1 WPB FL Lawyer David Glatthorn
West Palm Beach personal injury attorney David J. Glatthorn begins a two-part series discussing independent medical examinations.
You may be asked to undergo an independent medical examination by the insurance company. This basically means another doctor hired by the insurance company examines you to confirm or refute your claim. These doctors are paid for by the insurance company and are not responsible for your medical care. Whether they spend 5 minutes – or an hour – with you, they get paid the same amount of money. So there’s no incentive to fully investigate the issue. Watch the video now to learn more.
- Are Independent Medical Examinations Really Independent? Part 2 WPB FL Lawyer David Glatthorn
West Palm Beach personal injury attorney David J. Glatthorn finishes his two-part series discussing independent medical examinations.
When undergoing an independent medical examination, you are examined by a doctor paid for by the insurance company. They are there to either confirm or refute your claim. A common way we see them do this now is when they claim you have a degenerative condition. Now that seems like a scary, terrible thing to have. But it’s a fancy way of saying you’re aging – just like we all are. Everyone begins to show degenerative changes as they get older. It’s perfectly natural, but to a judge or jury this may sway them into thinking your medical issues cannot be claimed by your accident. I help guide them into understanding that the defense is trying to fool them by making the doctors answer some basic questions to get to the truth. Watch the video now to learn more.
- Attorney David Glatthorn Explains 3 Things to Look for in a Florida Personal Injury Lawyer
West Palm Beach attorney David J. Glatthorn explains how there are 3 very important things to look for when deciding to hire an attorney.
First and foremost, is the lawyer must be competent in the area you need him in. Obviously, a skilled lawyer who knows how to ask the right questions is important to your case. The next thing you want to know is if they have real trial experience. The last person you want for your case is someone who's just getting their feet wet in trials. - Does Every Case Go to Trial? FL Injury Attorney David Glatthorn Explains
West Palm Beach attorney David J. Glatthorn talks about how people ask him if every case goes to trial.
Lots of personal injury cases actually never go to trial, they get settled beforehand. In the state of Florida cases get handled before trials by mediation or arbitration. A mediator is simply a third person who listens to both sides and helps them come to an agreement. Arbitration is where a private judge makes a decision on the spot -- just as if he were the jury. - What Questions Will the Jury Have to Answer If Your Case Goes to Trial? FL Attorney David Glatthorn
West Palm Beach attorney David J. Glatthorn talks about what questions the jury will have to answer if your case goes to trial.
Each jury member will have to answer two to five questions based on their trial. The first and second questions, whether or not the plaintiff -- or the defendant -- is negligent will lead them to the others. The jury then asks if the injured person suffered any permanent injury, including pain and disability. From that answer they must continue on to ask what the medical bills have been and will be. Lost wages -- past and future -- are then calculated next. The final question deals with "human losses". What that means is things like pain and disability, and the loss of enjoyment of life. There are no standard amounts in these areas, and the jury is responsible for coming up with a reasonable amount. Watch the video now to learn more.

In a deposition the other side will take what you say with literal value, so don’t be conversational. Also, we look at ways to counteract video. Like did they shoot 10 minutes out of 3 days?
